Hirecode Terms and Conditions

1. Introduction

These Terms and Conditions govern your access to and use of the Hirecode platform, including all features, tools, assessments, reports, and services available at hirecode.me and any related subdomains. By accessing or using Hirecode in any capacity, you agree to be bound by these terms. If you do not agree, you should not use the platform.

Hirecode is built on a straightforward idea. Every other technical assessment platform evaluates what a candidate submits. Hirecode evaluates how they built it. We capture behavioral signals, edit patterns, explanation depth, and code quality together to give hiring companies a genuine and confident signal about engineering ability. That process involves collecting and analyzing a meaningful amount of data, and these terms exist to make clear what that means for everyone involved.

If you are using Hirecode on behalf of a company, you confirm that you have the authority to bind that company to these terms. Please read this carefully before using the platform or completing any payment transaction through it.


2. Who We Are

Hirecode operates under the trade name HireCode and is registered in India as a micro and small enterprise under the Udyam Registration scheme of the Ministry of Micro, Small and Medium Enterprises, Government of India. We are an early-stage venture operating under this registration and have not been incorporated as a private limited company or any other corporate entity under the Companies Act, 2013.

We are based in India and serve companies and candidates both within India and internationally. These terms are governed by the laws of India. For users located in other jurisdictions, applicable local laws including the GDPR for EEA and UK users also apply to relevant aspects of our service.

3. Definitions

Platform means the Hirecode web application, APIs, tools, and services available at hirecode.me and any related subdomains.

Company means any business entity that creates a Hirecode account to assess candidates as part of a hiring process.

Company User means any individual including CTOs, engineering leads, hiring managers, and team members who accesses the platform on behalf of a Company.

Candidate means any individual who receives an invitation to complete a technical assessment through the platform.

Assessment means the end-to-end evaluation experience on the platform including the coding environment, behavioral capture, micro-interview, and generated report.

Report means the evaluation output generated by Hirecode after a Candidate completes an Assessment, including authorship scores, behavioral analysis, skill breakdowns, and micro-interview transcripts.

Subscription means the recurring paid plan under which a Company accesses the platform.

Payment Gateway means the third-party payment processing service used by Hirecode to collect and process subscription payments, including Razorpay and any other RBI-compliant provider we may use.

Service means the software-as-a-service product delivered digitally by Hirecode through the platform.


4. Nature of Service and Delivery

Hirecode is a software-as-a-service platform. We do not sell or ship any physical goods. The Service is delivered entirely online through the platform at hirecode.me.

Upon successful subscription and payment confirmation, access to the platform is granted digitally and immediately or within a reasonable short period. Company Users will receive a confirmation email at the registered email address with details of their active Subscription and instructions to access the platform.

The Service includes the ability to create and manage technical assessments, invite candidates, access the live coding environment, generate AI-powered evaluation reports, and use all features available under the subscribed plan at the time of purchase. Specific features available under each plan are described on the pricing page at hirecode.me.

Hirecode does not guarantee a minimum number of assessments or hires. The platform is a tool to support hiring decisions and its value depends on how it is used by the Company.


5. Account Registration

5.1 Company Accounts

To use Hirecode as a hiring company, you must register for an account by providing accurate and complete information including your name, work email address, and company details. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you become aware of any unauthorized use of your account, you must notify us immediately at hello@hirecode.me.

Each Subscription is issued to a single Company. You may not share your account with another company or use a single account to assess candidates on behalf of multiple unrelated businesses.

5.2 Team Members

Company Users may invite additional team members to access the workspace. The account holder is responsible for ensuring that all team members comply with these terms. Access permissions can be managed through the team settings within the platform.

5.3 Candidate Access

Candidates do not create accounts on Hirecode. They access the platform through a unique, time-limited invitation link generated by a Company. Candidate access is restricted to the specific Assessment for which they have been invited and expires once the Assessment is complete or the link reaches its expiry.

5.4 Accurate Information

You agree to provide accurate, current, and complete information when registering and to keep that information updated. Hirecode reserves the right to suspend or terminate accounts where information provided is found to be false, misleading, or incomplete.


6. Subscriptions and Billing

6.1 Subscription Model

Access to Hirecode for Companies is provided on a paid monthly subscription basis. Subscription fees are charged in advance at the beginning of each billing cycle. Details of available plans and their pricing are published on the pricing page at hirecode.me and may be updated from time to time with reasonable advance notice to existing subscribers.

6.2 Payment Processing

All payments on the Hirecode platform are processed through our Payment Gateway partner, currently Razorpay, which is compliant with the guidelines of the Reserve Bank of India. By subscribing, you authorize Hirecode to initiate a charge to your chosen payment method through the Payment Gateway on a recurring monthly basis.

Hirecode does not collect, store, or have access to your full payment card number, CVV, UPI PIN, net banking credentials, or any other sensitive payment authentication data. All such information is entered directly into the Payment Gateway's secure interface and is governed by their security standards and privacy policy.

6.3 Accepted Payment Methods

We accept all payment methods supported by our Payment Gateway partner at the time of purchase. This currently includes credit cards, debit cards, UPI, net banking, and wallets where applicable. Accepted methods may change from time to time and will be displayed at the point of checkout.

6.4 Billing Cycle and Renewal

Subscriptions renew automatically at the end of each monthly billing cycle unless cancelled before the renewal date. You will receive a reminder email before each renewal. Continued use of the platform after a renewal date constitutes acceptance of the charge for the new billing cycle.

6.5 Failed Payments

If a scheduled payment fails, we will notify you by email and attempt to collect the payment again. If payment remains outstanding after reasonable retry attempts, we reserve the right to suspend access to your account until the outstanding balance is settled. Hirecode is not liable for any loss or inconvenience caused by suspension due to a failed payment.

6.6 Invoices and GST

Hirecode will issue a digital invoice for every successful payment to the registered email address of the account holder. Where applicable under the Goods and Services Tax framework, GST will be applied to subscription fees at the prevailing rate and shown clearly on the invoice. It is the responsibility of the Company to provide accurate GST registration details if they wish to claim input tax credit.

6.7 Pricing Changes

Hirecode reserves the right to revise subscription pricing at any time. Existing subscribers will be given at least 30 days written notice of any price change before it takes effect on their account. Continued use of the platform after the effective date of a price change constitutes acceptance of the new pricing.


7. Cancellation Policy

7.1 Cancellation by Company

Company Users may cancel their Subscription at any time through the account settings page or by writing to us at hello@hirecode.me. Cancellation requests submitted by email will be processed within 2 business days of receipt.

7.2 Effect of Cancellation

Cancellation takes effect at the end of the current billing cycle. You will retain full access to the platform until the end of the period for which you have already paid. After the billing cycle ends, your account will be deactivated and you will no longer be able to create new assessments or access new reports.

7.3 Data After Cancellation

Following account deactivation, your data will be retained for a period of 90 days during which you may request an export of your reports and account data by writing to hello@hirecode.me. After this period, data will be handled in accordance with our Privacy Policy and applicable retention obligations.


8. Refund Policy

8.1 General Policy

All subscription fees paid to Hirecode are non-refundable except in the specific circumstances described in this section. By subscribing, you acknowledge that you have read and understood this refund policy.

8.2 Eligible Refund Circumstances

A refund may be considered in the following circumstances. First, if you were charged incorrectly due to a technical error on our platform or on the part of our Payment Gateway, you are entitled to a full refund of the incorrectly charged amount. Second, if the platform was completely inaccessible for more than 72 consecutive hours during your active billing period due to reasons within our control, you may be eligible for a pro-rated credit or refund for the affected period. Third, if you were charged after submitting a valid cancellation request that was acknowledged by us in writing, you are entitled to a refund of the amount charged after the cancellation was confirmed.

8.3 How to Request a Refund

To request a refund, write to us at hello@hirecode.me with the subject line "Refund Request" and include your registered email address, the transaction reference number, the date of the charge, and the reason for the refund request. We will acknowledge your request within 48 hours and provide a resolution within 7 business days.

8.4 Refund Processing Time

Approved refunds will be processed back to the original payment method used at the time of purchase. Refunds typically reflect within 5 to 10 business days depending on your bank or payment provider. Hirecode is not responsible for delays caused by your bank or the Payment Gateway once the refund has been initiated from our end.

8.5 Disputes and Chargebacks

If you initiate a chargeback through your bank or card provider without first contacting us at hello@hirecode.me to resolve the matter, we reserve the right to suspend your account pending investigation. We strongly encourage you to contact us first as most billing concerns can be resolved quickly and directly.


9. Acceptable Use

9.1 What You Agree To

By using the platform, you agree to use it only for its intended purpose of conducting legitimate technical hiring assessments. You agree to comply with all applicable laws and regulations. You agree to treat Candidates fairly and to use Reports only to inform genuine hiring decisions.

9.2 What You Must Not Do

You must not use the platform to assess individuals without their knowledge or consent. You must not share Assessment problems or question sets with third parties in a way that would allow Candidates to prepare for specific questions. You must not attempt to reverse engineer, decompile, or extract the underlying algorithms, models, or logic that power the platform. You must not use the platform to discriminate against Candidates on the basis of characteristics protected under Indian law or the laws of any other applicable jurisdiction including caste, religion, gender, disability, or national origin. You must not attempt to gain unauthorized access to any part of the platform, other accounts, or our infrastructure. You must not upload or transmit malicious code, viruses, or any content that could damage or interfere with the platform or its users.

9.3 Candidate Conduct

Candidates are expected to complete Assessments honestly and without using unauthorized assistance. Candidates must not attempt to circumvent the behavioral capture systems or misrepresent their own abilities through deliberate manipulation of session data. Hirecode's systems are designed to detect patterns consistent with AI-assisted code generation and other forms of misrepresentation, and these signals will be reflected in the Report delivered to the Company.


10. Data, Privacy, and Candidate Consent

10.1 Privacy Policy

Your use of the platform is also governed by our Privacy Policy available at hirecode.me/privacy. The Privacy Policy explains in full what data we collect, how we use it, how long we retain it, and what rights users and Candidates have over it. These terms and the Privacy Policy should be read together.

10.2 Company Responsibilities

When a Company invites Candidates to complete an Assessment, the Company acts as the data fiduciary or data controller for that Candidate's personal data. Companies are responsible for ensuring they have a lawful basis to collect and process Candidate data, for informing Candidates that they will be assessed using the Hirecode platform, and for complying with applicable data protection laws including the Digital Personal Data Protection Act, 2023 and the GDPR where relevant.

10.3 Candidate Consent

Hirecode collects explicit consent from every Candidate before an Assessment begins. This consent covers the collection of behavioral data including keystrokes, paste events, idle periods, tab switches, and post-submission responses. No Assessment data is processed without a valid consent record. Companies must not pressure or coerce Candidates into providing consent.

10.4 Payment Data

Hirecode does not store sensitive payment data. All payment processing is handled by our Payment Gateway partner in a PCI-DSS compliant environment. Transaction records retained by Hirecode are limited to payment status, transaction reference numbers, and billing details necessary for invoicing and legal compliance.


11. Intellectual Property

11.1 Platform Ownership

All intellectual property in the Hirecode platform including the software, algorithms, AI models, evaluation methodology, user interface, design, branding, and all content generated by Hirecode is owned by or licensed to HireCode. Nothing in these terms transfers any ownership of platform intellectual property to you.

11.2 Assessment Problems

Assessment problems generated by our AI engine are unique to each Candidate and session. These problems are the intellectual property of HireCode. Companies and Candidates do not acquire any ownership rights over generated problems by virtue of receiving or completing an Assessment.

11.3 Candidate Code

Code submitted by a Candidate during an Assessment remains the intellectual property of the Candidate. By completing an Assessment, the Candidate grants Hirecode a limited, non-exclusive license to process, analyze, store, and include that code in the Report delivered to the Company, and to use it in anonymized and aggregated form for platform improvement.

11.4 Company Content

Content uploaded or created by Company Users such as custom role templates or branding assets remains the intellectual property of the Company. By uploading such content, the Company grants Hirecode a limited license to use it solely for the purpose of delivering the platform services.

11.5 Feedback

If you provide feedback, suggestions, or ideas about the platform, you grant Hirecode the right to use that feedback without restriction or compensation.


12. Confidentiality

12.1 Platform Confidentiality

Hirecode's evaluation methodology, scoring algorithms, behavioral fingerprinting logic, and AI model architecture are proprietary and confidential. You agree not to disclose, reproduce, or attempt to reverse engineer any part of these systems.

12.2 Report Confidentiality

Reports generated by Hirecode are intended for internal use by the Company that commissioned the Assessment. Companies should treat Reports as confidential documents and limit their distribution to individuals directly involved in the relevant hiring decision. Reports must not be shared publicly or used for purposes unrelated to the hiring decision for which they were generated.

12.3 Candidate Data

Companies agree to handle Candidate data contained in Reports with appropriate care and in compliance with applicable data protection law. Candidate data must not be shared with third parties outside the hiring process without the Candidate's consent.


13. Disclaimers and Limitations

13.1 No Hiring Guarantee

Hirecode provides tools and signals to support hiring decisions. We do not guarantee that any Candidate assessed as a Strong Yes will perform well in the role, or that any Candidate flagged with risk signals will perform poorly. The Report is one input into a hiring decision and should be used alongside other assessments, interviews, and professional judgment. The final hiring decision remains entirely with the Company.

13.2 Platform Availability

We aim to keep the platform available and reliable at all times. However, we do not guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, updates, or circumstances outside our control. We will make reasonable efforts to notify users of planned downtime in advance.

13.3 AI Accuracy

Our AI-generated problems, behavioral analysis, and authorship confidence scores are produced by machine learning systems and are not infallible. Hirecode does not warrant that any AI-generated output is free from error. Companies should apply human judgment when interpreting Reports and should not rely solely on automated scores when making decisions that significantly affect Candidates.

13.4 Limitation of Liability

To the fullest extent permitted by applicable law, Hirecode's total liability to any Company or Candidate arising out of or related to the use of the platform shall not exceed the amount paid by that Company in the three months immediately preceding the event giving rise to the claim. Hirecode is not liable for any indirect, incidental, consequential, or punitive damages arising from use of the platform, including loss of business, loss of data, or hiring decisions made in reliance on platform outputs.


14. Indemnification

You agree to indemnify and hold harmless HireCode and its team members from and against any claims, liabilities, damages, losses, and expenses including reasonable legal fees arising out of or related to your use of the platform, your violation of these terms, your violation of any applicable law, or any hiring decision you make based on platform outputs.


15. Termination

15.1 By You

Company Users may terminate their account at any time by cancelling their Subscription in accordance with Section 7 of these terms and ceasing use of the platform.

15.2 By Hirecode

Hirecode reserves the right to suspend or terminate access to the platform at any time if we reasonably believe that you have violated these terms, engaged in fraudulent or harmful conduct, initiated an unjustified chargeback, or used the platform in a way that creates legal or reputational risk for us or for Candidates. We will provide notice of termination where it is reasonable and practical to do so.

15.3 Effect of Termination

Upon termination, your right to access the platform ceases. Data associated with your account will be handled in accordance with our Privacy Policy and applicable data retention obligations. Provisions of these terms that by their nature should survive termination including intellectual property, confidentiality, payment obligations, disclaimers, and indemnification will continue to apply after termination.


16. Governing Law and Dispute Resolution

16.1 Governing Law

These terms are governed by the laws of India. Applicable statutes include the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, the Indian Contract Act, 1872, and the Goods and Services Tax framework. For data-related matters affecting users in the European Economic Area or the United Kingdom, the GDPR also applies.

16.2 Dispute Resolution

In the event of a dispute arising out of or relating to these terms or the use of the platform, both parties agree to first attempt to resolve the matter through good faith negotiation by contacting us at hello@hirecode.me. If the dispute cannot be resolved through negotiation within 30 days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be India and proceedings shall be conducted in English.

16.3 Consumer Disputes

If you are an individual consumer and your dispute relates to a payment or billing matter, you may also approach the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019 if the matter is not resolved to your satisfaction through our internal process.

16.4 Jurisdiction

For matters not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts of India.


17. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our platform, our business, or applicable law. When we make material changes, we will notify Company Users by email and display a prominent notice within the platform at least 30 days before the changes take effect. The updated terms will carry a revised effective date at the top. Continued use of the platform after the effective date constitutes acceptance of the revised terms.


18. General Provisions

18.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy available at hirecode.me/privacy, constitute the entire agreement between you and Hirecode regarding the use of the platform and supersede all prior agreements or understandings on this subject.

18.2 Severability

If any provision of these terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

18.3 No Waiver

Our failure to enforce any right or provision of these terms at any time does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. Hirecode may assign its rights and obligations in connection with a business transfer, subject to the notification obligations described in Our Privacy Policy.

18.5 Force Majeure

Hirecode is not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control including natural disasters, government actions, internet outages, Payment Gateway downtime, or failures of third-party infrastructure providers.
